We are doing this petition to bring needed attention to how domestic violence is handled in our court system, when it come to one person versus another Example, man or woman. The out come of my son’s case Jason Blu Griffith is a clean example of this. In today society we need to wake up and smell the coffee. We now have many states that have legalized same sex marriages. SHOULD NOT ONE'S DOMESTIC VIOLENCE HISTORY BE FACTOR IN WHEN DEALING WITH AN DOMESTIC VIOLENCE CASE BE IT HETEROSEAXUALS, BISEXUAL, OR HOMOSEXUAL COUPLE!
Society as a whole has a double standard when viewing domestic violence cases. Now let's be serious when you hear the media talk about domestic violence, the first thing that comes to mind is that poor woman what have been to her. No one thinks that it may be a man! Society teaches us that a man is never to hit a woman no matter what. But is it right for a woman to hit, kick, push, smack, poke in the face, spit on a men or damage a men property? It is a two way street and not a one-way street.
Should not a man receive the same assistance under the law when calling the police in a domestic violence situation at his home as a woman would? Should not our laws on stalking, harassing, threatening, e-mail, texting, calling some one numerous time in one day, an destroying some one's property apply to all i.e. women or men? Do not the people who we count on to protect and serve us have a duty to carry out the laws of our state in accordance with our constitution without discrimination or bias? Does not a jury have the right to see and hear any and all evidences in a case especially when both sides are talking and cross-examining witness about the evidences? Today on television programs such as Judge Mathis, Alex, and many other, shows, we see and hear people playing voice recording and showing e-mail, in order to help then win their case. Why should it be any different in a domestic violence case? The media told the public about Tavon Martin’s past and the media is always talking about someone past be it the victim are the defended. This usually occurs when police officer kills someone .
The media can always tell you about the past of the person the office killed, but you do not hear about those offices records and how many complains may have been filled again the office. Is this equal justice? How would you feel if you were told right before your son's trial was to start that day, that if he was an women he would have been treated differently, given the documented violet past of the deceased Debbie Flores Narvaez and her mental condition? Jason Griffith was not charge with the dismemberment of Debbie Flores body, only with her death. That the district attorney would have changed him as he has done in the pass with women in similar situations with manslaughter. How ever because of all of the negative media attention and polities that go on in our society this was not done.
After trial it was said that there was a lot of errors made in my son's case, that these errors were serious enough to affect the out come of his trial, his fifth, sixth, and fourteenth amendment rights were violated. The fifth and, which was violated in his own case was due to the fact that the Judge presiding over the case mandated that he take the stand. His Sixth amendment was violated when the District Attorney questioned
Griffith about things the alleged roommate Louis Colombo stated. Jason’s attorney however, never was awarded the opportunity to cross-examine Louis Colombo The fourteen amendments to the constitution have promised equal protection of the laws to all person, be you woman or man.
The case of Maria Tersa federal civil right lawsuit filed October 9, 1996. Ninth circuit federal court of appeals July 20th 2000-A person has a constitutional right to a non-discriminatory police services. This landmark decision is now binding law in all states and jurisdictions of the United States.9th judicial district. Alaska, Arizona, California. Hawaii, Idaho, Montana, NEVADA, Washington, Guam and the northern Mariana isles.
Until we as an whole start to stand up and make our court and police department follow the laws of the constitution we will continue to have our son's and daughter treated differently. There are a lot of places that a women can go to for help in a domestic violence case, How ever there are little to none that a men can go to. Some day I would like to start a place for men to go to and get the same type of services that are offered to women. I would call it when George screamed. If after viewing, listening and reading the information in this case please sign our petition. Remember to keep an open mind for this could be you one day or someone you love. The system failed them both.
